#452: Bill Cosby Update with Nicki Weisensee Egan | Part 1

2023-07-05

In this episode, we interview award-winning investigative journalist turned author Nicki Weisensee Egan about the latest updates regarding Bill Cosby, including six women who have filed civil suits against Cosby in New York City, one woman filed in New Jersey, another in California and a further nine women in Nevada. Nicki wrote the book 'Chasing Cosby' and hosted the podcast of the same name.

To be clear, in 2018 Bill Cosby was found guilty in a criminal court of law for drugging and sexually assaulting Andrea Constand at his home (three felony counts of aggravated indecent assault). He was sentenced to three to ten years. However, he was released after serving only two years in 2021. He was not exonerated. He was never acquitted. His release had everything to do with a bizarre pre-trial procedural interpretation that his lawyers were able to convince a Pennsylvania Supreme Court to agree with, something Jim weighs in on. Cosby’s PR team and attorneys constantly try to spin the narrative on this. Laura reads out a communication Nicki received from Cosby's PR person, (which also references Laura) and you won’t believe your ears on how he is desperately trying to re-write Cosby’s history of sexual assault allegations. Join our discussion on why these new civil cases are important for holding Cosby accountable for his alleged actions. Bill Cosby has always denied any wrongdoing and all charges. Trigger warning: Listener discretion is advised.

ask crime, analyst and founder of paladin national stalking, advocacy service, and with me today is I am Jim Clemente retarded pr profile of former new york city prosecutor writer producer of criminal minds. Hi, I'm LISA is embedded in the casting director of serious criminal minds and I've cast many many fictional characters who are shameless unrepentant real sexual offenders, who seem bigger than life, that these kinds of offenders are in our real lies and they defies belief with their brazenness and the effort to bring them to justice. Defies reality, with us today to talk about one such real life. Cereal sex offender is I'm Nicky wisely the again I'm an author and investigative journalist. I wrote a book chasing cosby and there was a podcast based on the book that I hosted an executive. now come on we're so happy to have you back Nicky, we ve taught with you.
However, since we last spoke well, I've spoken to you on crime analysed and we had a really interesting conversation, and I know we're gonna go back to that bert. And since then more has happened at all No I'm real crime profile might not have heard your pv since spill, cause Cosby was released. Do you want to walk workers through that? your point of view on it and then we're dive into old and new things that are going on currently, shore causing who was convicted of drug in sexually assaulted, andrea can, in April two thousand and eighteen and then Months later he was after seventeen hearing. He was sentenced to three to ten years in prison and here has been denied parole because right before his release, because he was designated a violent sexual offender, they were supposed to be going to sexual assault. You no type of counts. concessions and so forth, and he was just refusing to go to a atlanta and looking back. Of course, he knew Eventually, gonna get out, it was just a matter of time. I don't think he thought it would take. That long
actually happened. Just short of his threaten his men, one sentence of three years, so he did do closed with minimum sentence. At least was two years and nine months wasn't that he served which team a green said she was just thankful tat. He had served. Time some time. Yes, she said that it is assign later I should like you know. I've thought about. We were kind car hunt you thought about that. I don't know. If I'm happy, you can bet you get it's just. She lives the law and she just thought the law is a beautiful thing, she's an attorney, and she thought at that point that the law, the legitimate I had freed him and it was a different thing when she realized know, there's that whole that decision was not based on the law, so she just a complete bow, see bill. Cosby was released two years ago. It was a decision by the pa in core that, I believe, was not based on any thing close to the law on they claimed is due process. Rights were violated by this alleged quo, promise not to prosecute by then diapers, castor and two thousand five, but that was
actually a press release. It was not an immunity agreements, so the days office did appeal, let bomb and that the only way that place they can appeal to the: u s supreme court and the: u s supreme court only heaters. I think one percent of the cases that is ass to here and they denied it so bill Cosby remains free. Now. What has happened, though, is because these women, who he they who say he drugged and sexually assaulted them cannot find justice in the criminal justice system. They have now taken their fight to the civil courts around the country. These so called book back laws have been passed, which gives section Salt survivors us a short window of time. In some cases, it unlimited like about adjusted to file civil suit against their attackers, no latin matter. How long ago it was so we ve got five women who filed exude against him was six actually
and a different suit against him and NBC and coarser werner warner and new york city on of course hosted. The cause me show slicks, women filed their lily. Bluely bernard was one of them. she also filed against him in new jersey and then just a couple Weeks ago, nine women filed against him in nevada and my understanding is they're going to be at least two more there and then one woman filed against him that tory valentino in California, I actually thought there would be more in california, given the fact that he was very active there for a very long time, but people tomorrow green who already won her defamation, lasted against unjust, really dont have not want to go through it. and also in the week. We know that in California, the the the statute of limitations is only five years, even though senator Rubio who's, our friend, is trying to get it extended to ten. But yeah, like you said, nevada has just blown the lid off of the whole concept of having a statute of limitations. Rightly
California, on the criminal sexual thought, cases await europe, they eliminated a statue limitations air, but these were further. civil servants, and it just gave them this look back window, but account looked back laws which gives them this a year or two window to file lawsuits against. It it no matter. How long ago was yeah in stature to of limitations were They come from the common law and basically they were set up, because at the time, literally was people's memories, its people, testifying that that is it and there was no forensics. There was no dna. There was no scientific backup to prove cases over a long period time and that's why they may have been relevant back then, because it was all dependent on somebody's memory, but today there so much more evident and they're. So little need for a statute of limitations. People can actually prove things decades way into the future, and so
They should be eliminated. They are irrelevant now and it's interesting because we talk about mad there being no statute of limitations. The matter and I've heard quite of lawyers. Weighing on this and safe like war. This is differ from you know the statute of limitations in sexual assault cases, while the evidence fade, witnesses might die. And there the reasons that they give for why the statue of limitations should remain, but that's the same for eddie murder cases while ralloo, so it just seems to be a non argument, but my goodness, he. The women have been through so much and we will continue to when I think that we on real crime profile, discuss the fact that he was released. Can we just couldn't understand the legal argument for that just seemed like his carriage of justice to have this press release being used, that nobody understood
to be this non prosecution agreement and for some reason, breeze, castor, testify to that, and he said, it wasn't immunity agreement- and his word just seem to count just find that baffling that just his word is enough right as the judges said bruce, you know how this works and immunity agreement has to be signed off on by a judge that didn't happen here and that's been caught. Castor start calling himself, he said eyes the sovereign of Montgomery county, I didn't have to do that. and so they went home to suit of reasons. Why that by that, that decision by the pizza supreme court was perplexing and there's a lot of evidence to show that there was no such agreement because during the discussion in doing about or civil law suit, against Cosby, I'm one of the things when they were suddenly net that aid that cause these attorney was that she would agree never to participate in a criminal case against him.
Her attorney sought that that was a violation of her rights and its obstruction of justice, though what they agree to was that she wouldn't initiate a criminal case, but why would end while academies attorneys want or need that if they had this promise not to prosecute already, which was not legal from bruce castor? So they get and are lies. I mean I do the police. He did not follow any of the procedures. How is that being held up as valid today? That's just bullshit. It's just a decision. Somebody wants to help out cause, be it has nothing to do with reality. It's really mad. And what did? I was interesting to me as I wrote about a whole big thing on my substance, about all the reasons why this decision made no sense, but just right after cosby was released. Andrew wyatt, his press secretary, I'm an interview- and I read about this and talked about it with laura. When I was on crime analysed where he says he got a call the week before this decision came out from nick this rapporteur for this
bizarre website called Y, see news which seems to exist only to write attack stories about andrea com, stand and other survivors, and he said knit said: you'd better get the pennsylvania, cosby gettin out next week, And so I asked how would he know that I asked indra why'd he met and the guys called nick the hack leave that believe it or not. Just his name and he's just gotten out of prison. Again. He was in there for sending racial emails. I forget the exact thing, but anyway and guess who has appeal boy or was it was pushed say don't forget, Nicky, who he's an for the appeal, was bruce castor right, so it there's just somebody things: they don't make sense there like how woodstock so
The PA supreme court has no time limit on deciding there's no way. You could know what it was going to decide or when it was going to decide. Unless you had a source on the inside and if nick the hat is an investigative reporter, then I will eat it. Fat because he is not there there's the fix was in. It has something to do with that whole group, because Not only did he know it was coming, he knew what the decision was and andrew wyatt at first was like. Oh nick was checking with the docket and he saw it and I'm like there is no doc doc tells you what the determination is right and and then he really went off on laura and I in his statement he sent a more detailed attack blast that night, but I just printed verbatim in my sub stack basically, but it was. It was so bizarre. He told this to us to stay calm, which is just so misogynistic like worthy
the hysterical females, but he has to you, know, keep it settled down yeah, and he did that during that the second cosby trial ever the piece, an interview with Judith reagan, because she was so furious after she got off the stand in support of janice Dickinson about the way she was treated and she called me and wanted to do an interview and I did one and andrew wyatt gave the most bizarre statement. I've ever seen. Afterward I sent it to laura because it was just it. It just defies explanation about why he would think that was even appropriate to say about I'm an especially in a sexual assault trial I.

It is I just a few historical, sound bites of the real, significant truth and facts surrounding MR costs. Be mr costa Then more than fifty years standing with the excluded made it possible for some to be included. Standing with the disenfranchised and standing with these women and men who had denied respect for work because of racing, under within the expenses of the entertainment industry. Those are the real, significant truth and facts on june, twenty seven, nineteen. Seventy three, Mr Cosby, was number one to six on Nixon's enemies list which included the tapping of her. office phones as well as twenty four surveillance and Mr Cosby and his family and his friends. Those are the real insignificant, trees and fax. Perhaps his power Black man had mystical powers to draw them right: white women under the watchful eyes. Fbi? along with your media. Cohorts like miss lure, richards haste of crime are, let us have this deep rooted obsession with Mr Cosby and the both of you have done: sorted and omitted trees intentionally the real significant tree, some facts. Despite your repeated, Reports of allegations against Mr Cosby none have ever been even in any court of law closer the real, significant truth and facts in june twenty one, the pencil date when it is, is lee untruth in june twenty one- the pennsylvania states supreme court release mr cosby and the courts late chief justice max by two- on the pennsylvania. try those recipes and the both of you might just get bored with journalistic malpractice. Thank you. What what remains is ran laura because we better around a lot of names who wrote this to you: so this is andrey, why of responding to Nicky, who We discussed this video that why the pr spokesperson for Mr Cosby he produce the video when he picked up cosby and talked about he was told a week before he was going to be released basically, and he should go to pennsylvania. Nicky queried that war. She couldn't tractor nick the hat because he was in prison. He was the one You told andrew why it and he was serving a prison sentence, say sheikh she talk to him. Andrey wire gave a first damon and then went in with this whole diatribe, which I found it. curious because its full of untruths allies, which is just bullshit. What are you gonna tell me? I struck a nerve with my questions because normally used
He's the typical pr guy, whose was very charming and sort of you know, but I say about the whole thing: undisposed response was that in the second one was just like I mean: let's talk about the ignorance of ok, so you saying that cause we would be unable to drug and rape women. If the f b, I was listening to his bones, bullshit bullshit, it has nothing to do with your phones. It has nothing to do with somebody tapping you. It is done in the privacy of our hotel room or another and- and that's just so stupid. It's an ignorant thing to hang your hat on, and it just shows how stupid he is when he was making a race issue as well yeah. What about white women and the black ma'am are actually many black women have come forward and made alive asian. So that's important father. He said that none of this has been proven in any court of law where there was Andrea com stands to try was, and then you ve judy
who, in santa Monica she won her k, say the jury found in favour of hair and against those cosby, So what he sang is factually incorrect and that's what he's continuing to say about the civil cases that now the women are bringing and by the way in twenty fifteen, some of the women like Judy when he was arrested had to stop their civil case. It wasn't a case they were not bringing these kay if they were and they got stopped because of their criminal case. But war andrey wide is now saying about the women, and this is why I find it so egregious is the the is about them. Basic one thing and being greedy for media attention, angry
in terms of money, and I just find not really despicable and when we ve skies thing we ve talked to them. They they hate going through this process. This process is onerous. Is how in fact Nicky just said she doesn't want to continue and do it again because it so bad? And this I know this is the system is not its geared towards protecting the defendant, because we don't want to convict somebody use innocent. So the defendant has many more protections then, the complainants or the victims too, and so it so outrageous to think that these women actually you're doing this for media attention. They're doing this, despite their doing this because of sister her they doing this, because it's the right thing to do, despite the fact that it is so difficult, so taxing, and it continues to drain that the entire time so
just bullshit, it's a hundred per cent bullshit and that's a sister how'd. You really see it in black and white. I will never forget the cover of new york magazine that had a picture of thirty five women who our probably a drop in the bucket that thirty five women staring straight out at the camera identifying themselves as causes survivors- and that must have been an incredibly difficult thing to do- and it's not a sisterhood that anybody wants to be in well and all of them thought they were the only victim, and that is what kept them silent for so many years, because he was an american dad. He was MR family friendly comedy, and they just and they had a hard time wrapping their heads around it. Also. You know he drugged them, so their memories were foggy about it too, and you know they were attacked when they do come forward. You know I'm glad you saw that side of andrew wyatt lore, because that's just not even that's a taste of what I went through in two thousand and five, when I was writing the
lorries, when none of the media wanted to two calibre and no other turn us wonder, cover it. It was a totally that's how they, after they were, threatening to sue us first, castor was threatening to have me arrested for some of my story, his iron and the media piled on me too. So you see, this is what they They were writing letters threatening to sue my newspaper Marty singer. His attorney was calling me nearly every day threatening to sue, but this debate, these, and this is how they operate and they intimidate people and to stay and silent or they try to buy them off, which is what they do with reporters with access and they do it with some of the survivors nano blame them. That's what cause we tried to do with into a constant. He tried to you know by her silence and she wouldn't do it. She wanted him to pay and chrome. You know in a cooking, a criminal court of law because she was worried. He would do it One else, and you know it's a valid. What concern, and I think that such an important point is not just about assist ahead of us ford and enjoying the throng it's about protection, protect,
other women future looking as well, and we the sexual predators, don't just stop, and I think you know when I read victoria valentino statement. I mean she has a civil seed in California Erin. She said that bill. Being- and I just want to directly quite new cosmetics, It's me when I was at my lowest point and we can see by grief, life how does she lost her son? And that was the point of vulnerability that he tapped into, and I think this is a very important point that he taps into that, mobility. I know we ve talked about it before, but he seems to be able to he's very a debt finding a way tap into vulnerability by ensuring that those people don't speak out and silencing them, not just in the moment. his found a recipe for what works. You shot. Women are basically in its still going on and yes Nicky. I did feel with Andrey Wyatt an m or talk about that in a minute. Once a finished. What victoria
Quite why she said, I hope this is my legacy to my family and those survivors who have yet to find their voices that hope and healing a possible- and I think that to me just sums up the exploitation and the targeting, but yet is still lives with women. Many dec, it's on and it has a cellular and physiological impact, and I can see that in all their health everyone, I spoke to it, the cosby event, Nicky talk, me about some elements that they had because trauma resides in the body and this is long lasting and this We'll cases are no easy solutions at all. I'm sure all the women in you can probably tell us more about that, but they ve taken these steps because they feel that they have into account. Particular criminal side has been closed down, because what the supreme court did was not just vacate his conviction
but they also ensured that he would never be prosecuted again, and that is another very baffling part to this whole story and why I applaud the women finding their voice. says and going down the civil, and it's not about greed, it's not about fame. None of these women want the attention and it's not the way that you, Come famous is through horrific sexual assault, ordeal and having to go through the pain at civil court of living through it all again just such a force, see and a false narrative, the andrew wyatt and his team gating and I just want to put it to bed now on that basis it none of these women want to go through again. They ve had a lifetime of it. They want it too wend, and they want the truth to be out on that. The important part, no one can do it through the criminal side, anymore, not disgraceful, to cut off out a victory access to justice through the criminal re that to me,

Why didn't you go to the police sooner or file these lawsuits sooner tomorrow? You know, I told her story first and the daily news in two thousand and five and and cosby's people took every bit of dirt in her past and dealt it out piece by piece to the media. About her I mean I got some of those emails and I remember she was asked about that like. Why? Didn't you do it sooner? She goes well. I came for in two thousand and five. This woman came forward in two thousand and five how's that going for her. You know cause andrea. They made up lies about her. The media, Cosby's people made up lies about her and the media ran with it. I mean they try to destroy you and the other financial implication of this is people like lily bernard who is an incredibly talented actress,
I remembered her. I don't know was her until I was right in my book in that she played this great. She had an extra character, a guest actor spot. Mrs Lucas's, with females mean if you are a brilliant actress and he blackballed her. After that I mean, after he drugged and assaulted her. He stole her career and lilies filed in also in nevada too. So there's a lot of these women. He just didn't drug and rape them. He tried to he destroyed the careers afterward, and so if they and then they did a lot of emotional damage to them, some of them struggled with addiction issues sunny with beautiful. Singer. Her career never really took off. After that, she was never able to have an intimate relationship for long after that she was a seventeen year virgin when he raped her back in nineteen sixty five and she said She would sleep with her arms and legs crossed over her chest in her growing area, because she just could not stand for any one to get close to her and she just struggle with that tire life. So he did some lifelong damage to these women somewhere,
well to go on and be okay, but a good chunk of them were not, and that's why these lawsuits, I think, are important. It's some. It's not justice and the criminal system that which they're not going to get, but at least it's a form of accountability, accountability, that's what they're, trying to they're trying to get The person who is the one who actually committed the crimes him held responsible period right and he's already appealing the duty. That was a civil case, that he is appealing that the the lower courts decided that rejected it. But I assume he is- and their california highest court. So he, even though it was only a thank you, shall I got five hundred thousand because they couldn't prove punitive because She had some other issues prior to this happening, but I wrote a piece for my son stack when that happened, because she was He nature when this happened, and I thought I dont think people realise how many of his victims were teenagers when he drugged and sexually assaulted them. So I wrote a piece about it. I think there were twelve or thirteen of the known
victims were teenagers and then the random barely have their teams. Andrea was actually the older ones. She was like thirty, thirty one when it happened, but mostly These were very young, impressionable women and, like Jim said, I think that one of the first interviews I was on, which is so incite, folded and we'll talk about vulnerability like with teresa and in the batter that he that she may he came up to him. The gift and he spotted her, and he just knew she was be just knew. He could controller and invited her to the shooting. I then drugged and raped her and german virgin talked about that like while we that's how quickly he could read people and he must have picked she's beautiful no doubt, but how did he know she would eat and she split she was very passive. She was raised catholic. She was raised to do what she was told, so he had this innate ability to really pick victims that he knew would not fight them. They had decades of experience learning.
